As an aside to my original posting, we sought legal advice about the whole deal and found out we don't have a case because my medical records were falsified, whether by accident or otherwise I can't say. My chart says I recieved pitocin AT DELIVERY instead of before and that I had local anesthesia BEFORE episiotomy instead of after. As for the membrane stripping procedure, my OB's didn't keep office notes so it's not notated ANYWHERE. The chart is looked at by a jury as fact whether it is or not. They will look at me like I'm a nutcase. I cannot even believe it. For those of you out there, file complaints against the State Medical Board in the state where you live and file complaints with the Joint Commission for Accreditation of Health Organizations if you can. At least it will be reveiwed by someone and will be a "paper trail" in case you find out there is something else wrong with your child down the road. We are afraid our son may be autistic and we won't be sure for 2 more years. You have until the child is 18 years old to file a claim on a minor. In my case though, my chart, the only "facts" we have, is completely bogus and I fear we may never be able to prove anything to anyone. At least we have a record of our complaint with the JCAHO, the State Medical Board of Ohio and the Hospital involved's Patient Complaint Department.
